Venture Legal Services makes use of collaborative negotiation, mediation and arbitration strategies to resolve disputes commercially and at least cost wherever possible. The firm is cognisant of the time and money involved in litigation in Ireland and often such strategies can deliver a better outcome for all parties than protracted litigation.
However, there are also times when – for one reason or another – the types of alternative dispute resolution (ADR) procedures described above are not available. In such circumstances clients may have little option but to litigate to protect their interests and in such circumstances the best course is usually to move as quickly as possible to secure the appropriate court orders.
Recent experience includes:
- mediation in the context of a dispute between the sellers and buyer of an Irish company;
- litigation in relation to the directors’ duties of an insolvent Irish company;
- various proceedings for the collection of debts in Ireland and abroad;
- engaging Turkish counsel on a dispute between an Irish and a Turkish company;
- mediation in the context of a high-value supply agreement;
- assisting an Italian resident company in defending a claim from its Irish customer; and
- resisting the efforts of a liquidator to seize assets belonging to a client.
